Terms of Service
By electronically completing or signing the Identification Registration, the USER will automatically adhere to and accept the terms and conditions of this Agreement. Tienda Havan may modify the terms of this Agreement at any time, and the USER, if not agreeing with the modification, may cancel without any cost or penalty.
For the purposes of these Terms of Use, the following definitions and descriptions should be considered for better understanding:

Antispam: System that prevents unwanted correspondence, such as mass advertising, by blocking messages or moving them to a specific folder.

Spider Application: Program developed to obtain information automatically on the Internet, browsing the web (the web) as if it were a spider.

Access Account: Credential of a registered visitor that allows access to restricted areas and exclusive functionalities, defined by a username and password.

Registration Data: Set of personal information of an internet user in a way that identifies them, distinguishing them from others, such as identity document number (DNI or RNE), individual (DNI) or corporate (CIF) registration, residential or commercial address, full name, among others.

Design: Set between the appearance, design, and flows of the site.

Link: Terminology for an internet address.

User: Username chosen by the visitor when completing the registration to access exclusive Portal functionalities.

Login: Act of the registered visitor entering the restricted area of the Portal using their username and password.

Records: Records of activities performed by visitors on the Portal.

Portal: Refers to the website address and its subdomains.

Password: Set of characters that serves as proof of the user's digital identity, whose knowledge must be exclusive and unique.

1 – Access and Functional Restrictions
This Portal is dedicated to the sale/marketing of products in general. To make a purchase, the visitor must complete their banking, identification, and address details in the payment platform registration (Cartpanda Pay), responsible for processing all orders made for Tienda Havan. Visitors and users are not allowed to access the programming areas of the Portal, its database, or any other set of information that is part of the webmastering activity, and those who do so are subject to penalties and are required to repair any damage caused. Reverse engineering, translating, decompiling, copying, modifying, reproducing, renting, sublicensing, publishing, disclosing, transmitting, lending, distributing, or otherwise disposing of the Portal's query tools and functionalities are also prohibited. The use of spider applications or data mining of any kind is forbidden on this Portal, as well as others not typified here, but that act as robots, either to carry out mass operations or for any other purpose. It is the responsibility of visitors and users to have the necessary means to browse this Portal, including internet access.
2 – General Information about the Site and Its Operation
This Portal is presented to the public on the web as it is available and may undergo continuous improvements and updates without Tienda Havan being obligated to maintain a particular structure or design, except for its own convenience. Access to the site and all operations carried out on it are governed by these Terms of Use, which are applicable to every person (Visitor or User) accessing the site. By accessing the site, the Visitor/User accepts all the conditions set forth in the Terms of Use, being solely responsible for all acts performed on the site or related to it. Tienda Havan makes every effort to ensure the continuous and permanent availability of the Portal, but it is subject to extraordinary events such as natural disasters, failures or collapses in the central communication systems and internet access, or actions of third parties that fall outside its scope of control and responsibility. Tienda Havan is not responsible for any damage, loss, or harm to the Visitors' and Users' equipment caused by system failures, server or internet connection issues, even if caused by third parties, such as malicious software, viruses, trojans, or other issues that could harm users' equipment or connection due to access, use, or navigation on this Portal, as well as data, files, images, texts, audios, or videos transferred on it. Visitors and Users do not have the right to demand the availability of the Portal according to their convenience, nor can they claim compensation for damages if the Portal is out of service, regardless of the reason. Tienda Havan is not responsible for visitors' and users' navigation on external links contained on the Portal; it is their responsibility to read the Terms of Use and Privacy Policy of the site they visit and act accordingly. In case of damages or harm, visitors and users will be primarily responsible, as they are required to navigate safely, since Tienda Havan only pointed the link, and it is up to the user/visitor to decide whether to visit the site or not. Tienda Havan is not responsible for actions carried out by its Visitors and Users in the environment provided by the Portal, each one should be held accountable according to their use of the platform. Tienda Havan may, at its sole discretion and convenience, delete or suspend the access account of a particular user from its Portal due to suspicions of inaccurate information or committing a criminal act. This authority does not exempt Visitors and Users from always providing truthful data and engaging in behaviors in line with the Portal's purpose and their registration.
3 – User Registration on the Website
Registration on the Platform is done through the payment link at the time of the product and/or service purchase. This registration is made freely and voluntarily by the User. To register on the Platform, personal data must be provided during the completion of specific fields, such as but not limited to, full name, ID number, address, email, and contact phones.
When the Visitor/User registers on this Portal, they must provide truthful and accurate information, committing to keep their data updated, under penalty of being held liable, as well as assuming any damages caused by the use of incorrect data or third-party data, regardless of fault. Registration on the Portal is free and may be carried out by individuals over 18 years of age or in full exercise of their civil capacity. By completing the registration, the Visitor acknowledges full knowledge of this document and the Privacy Policy, available in all the Portal's links, as the claim of ignorance will not exempt them from responsibilities or improper actions when using the Portal. Users may also leave testimonials, comments, and/or opinions about the services and products advertised on the site. Such information will be stored according to Tienda Havan's Privacy Policy. The User who submits personal testimonials, comments, and/or opinions about the services and products advertised on the site, automatically authorizes Tienda Havan to use this material both on the site and in other media for advertising purposes. Upon completing their registration, the User may opt to receive Tienda Havan's newsletter by email, which will contain informative and commercial material related to the site. If they no longer wish to receive the newsletter, the User can simply click on the unsubscribe link in the email to request removal from the newsletter list. To cancel their registration or placed orders, the user must make their request directly on the Portal.
4 – Communication from the Company with Its Visitors and Users
The company will use the email provided during interaction with the site as the main communication channel with its Visitors and Users, including the site's native messaging system and WhatsApp, available in the site’s footer.
It is the responsibility of the Visitors and Users to receive communications and ensure they provide correct and updated data to Tienda Havan. It is also their responsibility to configure their antispam systems so that they do not interfere with receiving important communications from Tienda Havan.
